EXCHANGE OF NOTES BETWEEN THE REPUBLIC OF THE PHILIPPINES AND THE FEDERAL REPUBLIC OF GERMANY CONCERNING THE GERMAN GRANT OF 5000 TONS OF FERTILIZER

Excellency:

I have the honour to propose on behalf of the Government of the Federal Republic of Germany the following Arrangement be concluded:

1. The Government of the Federal Republic of Germany shall supply to the Government of the Republic of the Philippines free of charge c.i.f. port of unloading Manila 5000 {five thousand) metric tons of ammonium sulphate.

2. The Government of the Republic of the Philippines shall

a) exempt the fertilizer listed all paragraph 1 from harbour dues, import duties and other public charges,

b) bear the cost of unloading, storage and transport from the port of unloading to the place of utilization. If the Government of the Republic of the Philippines agrees to the pro-posals contained in paragraphs 1 and 2 above, I have the honour to suggest that this Note and your Excellency's Note in reply thereto expressing the agreement of your Government shall constitute an Arrangement between our two Governments, to enter into force on the date of your reply.

Accept, Excellency, the assurance of my highest consideration.

I have the honor to acknowledge the receipt of your Note dated 16 April 1971, which reads as follows:

"Excellency,

I have the honour to propose on behalf of the Government of the Federal Republic of Germany the following Arrangement be concluded:

I wish to confirm the proposal that your Excellency's note and my note shall constitute an agreement between our two Governments, to enter into force on the date of my reply.
