AGREEMENT BETWEEN THE PROVINCE OF SOUTH COTABATO AND THE TECHINT CAMPAGNIA TECNICA INTERNAZIONELE-MILANO AND CONTEC-ROMA BASED ON THE AGREEMENT FOR SCIENTIFIC AND TECHNICAL COOPERATION BETWEEN THE REPUBLIC OF THE PHILIPPINES AND THE REPUBLIC OF ITALY

On the basis and within the framework of the AGREEMENT FOR SCIENTIFIC AND TECHNICAL COOPERATION between the Philippines and Italy, signed in Manila on February 13, 1969, the Province of South Cotabato and Techint Compagnia Internazionele-Milano in cooperation with Comtec-Roma (or TECO), both parties having been authorized by their respective Governments to enter into this Agreement, have agreed as follows:
1. TECO will send to South Cotabato within a period of not more than ninety (90) days from the signature of this Agreement a Technical Mission, hereinunder referred to as Mission, to execute the program of surveys and studies in South Cotabato according to the scope of work hereinafter defined.
The Mission shall be composed of four members, each representing the following specializations:
a. Planning Engineer
b. Economist
c. Agronomist, and
d. Industrial Engineer
Services of Consultants in specific fields necessary to assist the work of the Mission in South Cotabato and as may be jointly determined by the Mission and South Cotabato should be provided by TECO.
2. Back staffing services of TECO in their Headquarters in Italy will also be made available for the analysis of the data collected by the Mission and in the preparation of the report of the survey.
3. TECO shall advise the Government of the Republic of the Philippines of the names of the members of the Mission and the consultants planned to be sent; it is understood that no Mission member or consultant will be sent to the Philippines before prior clearance from and acceptance by, the Government of the Philippines.
4. The scope of work of the Technical Mission consists of making a general survey and plan for the agro-industrial development of South Cotabato, including layout of the main infrastructures deemed important for the sound development of the province. The Mission shall also look into the feasibility of specific industrial and agricultural projects that may be found essential to the development of South Cotabato.
For this purpose, the Government of the Republic of Italy has granted TECO the sum of 50 million It. Lire to be spent for the execution of the studies and surveys covered by the present Agreement.
5. In his capacity, as the Executive Officer of the implementing agency for this Agreement, the Provincial Governor of South Cotabato shall exercise overall supervision, in close consultation with the assisting agency, in the conduct of the survey related to this Agreement.
6. Within two weeks from the arrival in the Philippines of the advanced party of the Mission a detailed working program including a general time schedule of accomplishing the work program shall be finalized by the Mission
and South Cotabato.
7. TECO shall make suitable arrangements for possible financial assis tance by the Government of the Republic of Italy in the implementation of agro-industrial projects that may be found feasible by the Mission.
8. South Cotabato shall insure that upon arrival of the advanced party of the Mission in the Philippines, the following shall be made available to the Mission:
a. General statistical data on South Cotabato updating the data contained in the "Economic Survey of South Cotabato of May 1968."
b. Maps available of the province.
c. Report of studies carried out in South Cotabato by the Government or other agencies on infrastructure, industries and agriculture.
d. Report of geological, geophysical and geochemical survey of the province or any geological information related to possible ore deposits.
9. South Cotabato will provide TECO free of charge the following services:
a. Transportation in the Philippines of the members of the Mission and consultants as may be determined necessary for the accomplishment of their task and as outlined in the detailed working program agreed upon.
b. Accommodation and other living expenses of the. members of the Mission and consultants while they are in South Cotabato.
c. Services of counterpart staff including labor jointly determined by the Mission and South Cotabato as necessary in the prosecution of the work of the survey.
d. Tools and instruments as may be jointly determined to be necessary in the conduct of the survey.
e. Access permits to private properties for carrying out the survey and residence permits in the Republic of the Philippines and security for the members of the Mission and consultants during the period required for them to accomplish the work outlined under this Agreement.
10. TECO shall within three months after completion of the survey as outlined in the detailed working program submit to the Government of the Republic of the Philippines twelve copies of the report of such survey. Representatives of South Cotabato as may be jointly arranged by the Mission and South Cotabato could participate in the preparation of the report.
11.The members of the Mission and consultants employed in this survey shall be accorded the privileges and benefits provided for in the Scientific and Technical Cooperation Agreement between the Government of the Republic of the Philippines and the Government of the Republic of Italy dated 18 February 1969.
12. This agreement shall enter into force upon signature.
This Agreement shall remain in force for a period of eight (8) months from the date of signature of this Agreement.
IN WITNESS WHEREOF, the Governor of the Province of South Cotabato and the representative of the TECO have signed the present agreement.
