EXCHANGE OF NOTES CONSTITUTING AN AGREEMENT BETWEEN THE PHILIPPINES AND JAPAN CONCERNING OVERSEAS TECHNICAL COOPERATION.

Excellency:
I have the honor to refer to Your Excellency's Note dated November 29, 1968, which reads as follows:
"Excellency:
I have the honor to refer to the recent conversations held in Manila by the representatives of the Government of Japan and of the Government of the Republic of the Philippines concerning the assignment in the Philippines of a resident representative of the Overseas Technical Cooperation Agency (OTCA) of Japan, to coordinate technical assistance under the Colombo Plan and advise the Japanese Embassy on the organization and functions of the OTCA for purposes of policy information.
It is my understanding that the Philippine Government will accord the following privileges to the resident representatives:
1. Exemption of the importation of personal and household effects and office equipment for the use of the OTCA representative from the payment of customs duties, taxes, and related charges;
2 Exemption of emoluments, including a living allowance, from the payment of income tax and related charges;
3. Exemption from the payment of visa and immigration fees and related charges.
It is also my understanding that any question that may arise from the implementation of this proposed agreement shall be the subject of consultations between our two Governments.
If the foregoing understandings are correct, I have the honor to propose that this note and Your Excellency's reply confirming the same shall constitute agreement between our two Governments which shall enter into force on the date of Your Excellency's reply and shall remain in force indefinitely until either Government serves a written notice of termination on the Other to take effect at the end of ninety days from the receipt of such notice.

I have the honor to confirm on behalf of the Government of the Republic of the Philippines the understandings set forth in the above-mentioned note and hereby agree Your Excellency's note and this reply shall constitute an agreement between our two Governments.
