AN ACT CONVERTING THE RAMON MAGSAYSAY MEMORIAL SCHOOL OF ARTS AND TRADES IN THE MUNICIPALITY OF IBA, PROVINCE OF ZAMBALES, INTO A POLYTECHNIC COLLEGE TO BE KNOWN AS THE RAMON MAGSAYSAY POLYTECHNIC COLLEGE, AND APPROPRIATING FUNDS THEREFOR

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:SECTION 1. The Ramon Magsaysay Memorial School of Arts and Trades in the Municipality of Iba, Province of Zambales, is hereby converted into a polytechnic college to be known as the Ramon Magsaysay Polytechnic College, hereinafter referred to as the College.SEC. 2. The College shall be under the supervision and control of the Department of Education, Culture and Sports.SEC. 3. The College shall offer one-year to three-year technical vocational courses and undergraduate courses in the field of industrial education and technology or such other courses which are relevant to the needs of its service area.SEC. 4. The College shall be headed by a vocational college superintendent to be appointed by the Secretary of Education, Culture and Sports.SEC. 5. The academic and administrative staff of the College shall be organized following the staffing pattern of the Department of Education, Culture and Sports for such type of schools pursuant to existing laws, rules and regulations.SEC. 6. All assets, fixed and movable, personnel, records and documents of the Ramon Magsaysay Memorial School of Arts and Trades in the Municipality of Iba, Province of Zambales, as well as its liabilities shall be transferred to the Ramon Magsaysay Polytechnic College: Provided, however, That the positions, rights and security of tenure of personnel therein employed pursuant to the existing laws prior to its conversion into the Ramon Magsaysay Polytechnic College are not impaired.SEC. 7. All parcels of land belonging to the Government occupied by the Ramon Magsaysay Memorial School of Arts and Trades are hereby declared to be the property of the Ramon Magsaysay Polytechnic College and shall be titled under that name: Provided, That should the Ramon Magsaysay Polytechnic College cease to exist or such aforementioned parcels of land be no longer needed by the College, the same shall revert to the Province of Zambales.SEC. 8. In addition to the current appropriations of the Ramon Magsaysay Memorial School of Arts and Trades, the amount needed to carry out the provisions of this Act shall be included in the General Appropriations Act of the year following its enactment into law and thereafter.SEC. 9. Tuition and other fees to be paid by students enrolled in post-secondary and higher education courses shall be retained and directly used by the College to improve the learning/training facilities.SEC. 10. Income derived from production and service activities undertaken in aid of instruction and training and from auxiliary enterprises shall be retained by the College and shall be used exclusively for the acquisition of tools, equipment and other laboratory facilities for instruction, research and produce/process development and for incentives of students, teachers and other school personnel directly involved in production and service activities: Provided, however, That such incentives shall not exceed thirty percent (30%) of the income: Provided, further, That the utilization of this income shall be in accordance with auditing rules and regulations.SEC. 11. Salary grades of faculty members, officials and other employees of the College shall be equal to that of their counterparts in state colleges and universities pursuant to the provisions of Republic Act Numbered Sixty-seven hundred and fifty-eight.SEC. 12. If for any reason any section or provision of this Act shall be held unconstitutional or invalid, no other section or provision hereof shall be affected thereby.SEC. 13. All laws, presidential decrees, executive orders, rules and regulations inconsistent with the provisions of this Act are hereby repealed, amended or modified accordingly.SEC. 14. This Act shall take effect upon its approval.Approved,

This Act which originated in the House of Representatives was finally passed by the House of Representatives and the Senate on May 16, 1991 and January 23, 1992, respectively.
