[ REPUBLIC ACT NO. 4140, June 20, 1964 ]
AN ACT AMENDING REPUBLIC ACT NUMBERED THREE THOUSAND SEVEN HUNDRED AND EIGHTY-THREE.
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:SECTION 1. Sections one and two of Republic Act Numbered Three thousand seven hundred eighty-three is amended to read as follows:
"SECTION 1. The Prosecution Division of the Department of Justice shall be composed of the following officials and personnel with annual compensation hereinafter fixed:
"Chief state prosecutor .......................... P16,000.00 "Two assistant chief state prosecutors, each at....................... 13,800.00 "Eight senior state prosecutors, each at .. 12,600.00 "Two senior state prosecutors, each at .. 12,600.00 "Five state prosecutors, each at ............ 13,400.00 "One state prosecutor .......................... 10,800.00 "Seven state prosecutors, each at ......... 10,200.00 "Six state prosecutors, each at ............. 9,600.00 "Seven state prosecutors, each at ........ 8,400.00 "One state prosecutor ......................... 8,400.00 "Administrative assistant ...................... 5,100.00 "One supervising senior stenographic reporter........................... 5,100.00 "Three senior stenographic reporters, each at......................... 4,800.00 "Three junior stenographic reporters, each at........................ 4,500.00 "Six junior stenographic reporters, each at.......................... 4,200.00 "One research attorney I ....................... 6,600.00 "One stenographer ............................... 3,600.00 "One statistical aide III ......................... 8,600.00 "One clerk I ......................................... 3,000.00 "One janitor-messenger ........................ 2,400.00 "SEC. 2. The Deportation Board of the Department of Justice shall be composed of the following officials and personnel with annual compensation hereinafter fixed:
"Chief prosecutor .................................. P11,400.00 "One trial attorney III ............................ 10,800.00 "Two trial attorneys II, each at ............. 8,400.00 "One legal officer I ................................ 7,200.00 "One secretary ...................................... 4,500.00 "One sheriff ........................................... 3,600.00 "One messenger-janitor ......................... 2,400.00"
SEC. 2. The same Act is amended by inserting between Sections two and three thereof, two new sections to read as follows:
"SEC. 2-A. The rank and qualifications for appointment to the position of chief state prosecutor, assistant chief state prosecutors and chief prosecutor of the Deportation Board shall be the same as those prescribed for judges of courts of first instance; the rank and qualifications for appointment to the position of state prosecutors and trial attorneys of the Deportation Board shall be the same as those prescribed for provincial fiscals."SEC 2-B. The officials, state prosecutors and trial attorneys hereinabove mentioned shall be appointed by the President with the consent of the Commission on Appointments: Provided, That the incumbent chief prosecuting attorney, trial attorneys IV and other trial attorneys and employees occupying positions affected by the preceding sections at the time of the effectivity of this Act, shall continue to occupy their respective positions and receive the salary increases herein provided without the necessity of any new appointment."
SEC. 3. Section three of the same Act is amended to read as follows:
"SEC. 3. The officials, attorneys, and employees mentioned in Sections one and two of this Act shall receive the salaries provided for herein, notwithstanding any provision of law to the contrary."
SEC. 4. In addition to such sums as may have been provided in the current Appropriations Act, there is hereby appropriated out of any funds in the National Treasury not otherwise appropriated, such sums as may be necessary to carry out the provisions of this Act.SEC. 5. This Act shall take effect upon its approval.Approved, June 20, 1964.
